Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Subly iOS application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms apply to all users of the App.

2. Description of the App

Subly is a personal subscription tracker that allows users to manually add and manage their recurring subscriptions. The App helps users monitor billing dates, track total spending, view insights by category, and receive reminders before renewals. Subly is available as a free version with limited features and a premium version called Subly Pro.

3. Eligibility

You must be at least 13 years old to use Subly. By using the App, you confirm that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian to use the App.

4. Free and Pro Plans

4.1 Free Plan

The free version of Subly allows you to track up to 3 subscriptions and access basic home screen spending summaries. Features including the billing calendar, spending insights, and smart notifications are reserved for Subly Pro subscribers.

4.2 Subly Pro

Subly Pro is a paid auto-renewable subscription that unlocks all features of the App. It is available as a monthly plan ($2.99/month) or a yearly plan ($19.99/year). Subly Pro subscriptions are billed through Apple's in-app purchase system and automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

4.3 Cancellation and Refunds

You may cancel your Subly Pro subscription at any time through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period. Refunds are handled by Apple in accordance with their refund policy. We do not process refunds directly.

5. User Responsibilities

By using Subly, you agree to:

• Use the App only for its intended purpose of personal subscription tracking
• Enter accurate and truthful information into the App
• Not attempt to reverse engineer, modify, or distribute the App
• Not use the App for any unlawful or fraudulent purpose
• Not attempt to gain unauthorized access to any part of the App
• Comply with all applicable laws and regulations in your jurisdiction

6. Intellectual Property

All content, design, graphics, logos, and code within the Subly App are the exclusive property of Hicham Badri and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our express written permission.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. All data you enter into Subly is stored locally on your device. We do not collect, store, or process your personal data on external servers.

8. Disclaimer of Warranties

Subly is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy of any subscription data, spending calculations, or notifications generated by the App. You use the App at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Hicham Badri shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to missed subscription renewals, unexpected charges, or data loss. Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for Subly Pro in the 12 months preceding the claim.

10. Third-Party Services

The App uses RevenueCat to manage in-app purchases and Apple's in-app purchase system for payment processing. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of these services is subject to their respective terms and policies.

11. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease. You may also terminate your use of the App at any time by deleting it from your device.

12. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the effective date at the top of this document. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes arising from these Terms or your use of the App shall be resolved in the competent courts of Morocco.

14. Apple App Store Requirements

As Subly is distributed through the Apple App Store, the following additional terms apply:

• These Terms are between you and Hicham Badri only, not with Apple Inc.
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any claims relating to the App
• In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for the investigation or defense of such claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms
